Terms of Service

These Terms of Service (“Terms”) govern your use of the Leeka mobile application and related services (the “Service”). The Service is operated by LEEKA, a French société par actions simplifiée (SAS) with share capital of €999, registered with the Paris Trade and Companies Register under number 108 437 344, whose registered office is at 94 Boulevard Flandrin, 75116 Paris, France. In these Terms, “Leeka”, “we”, “us”, and “our” refer to LEEKA as the operator of the Service.

1. Acceptance of these Terms

These Terms are a binding agreement between the user and LEEKA.

These Terms and the Privacy Policy are made available to the user, through a link displayed immediately next to the account-creation button, before any account is created. By creating an account, the user accepts these Terms and the Privacy Policy. The date of that acceptance and the version of the Terms then in force are recorded.

A user who does not accept these Terms must not create an account or use the Service.

2. What Leeka is

LEEKA operates an application that allows runners preparing for the same race with the same goal time to group together in crews. The Service supports the coordination of sessions, the exchange of messages, and the sharing of content.

LEEKA publishes proposed meet-ups in the app, each with a date, a time, a meeting point, a session type, a distance, and a pace. These details are provided for information only and constitute a proposal of practical arrangements, which each user is free to join or not.

LEEKA provides no sports supervision within the meaning of Article L. 212-1 of the French Sports Code. No coach, trainer, sports instructor, or employee of LEEKA directs, watches over, or supervises how sessions unfold. No technical instruction, no individual programme, and no monitoring of effort is delivered by LEEKA during sessions. LEEKA is neither a coaching service nor a medical service.

Some partner programmes may designate, from among their own members, people identified in the app by a “coach” or “admin” label. Those people act on behalf of the partner concerned and are neither employees, nor agents, nor sports instructors of LEEKA. LEEKA exercises no authority over them and delegates no supervisory role to them.

Each participant remains solely in control of their participation, their actual route, their pace, their effort, and their decision to stop the session at any time. It is for them to check that the session on offer matches their state of health and their level.

These provisions neither aim nor operate to exclude LEEKA’s liability for fault personally attributable to it, in particular in the information provided to users.

3. Accounts and eligibility

• The Service is reserved for adults. The minimum age required is 18. By creating an account, the user declares that they are of legal age.
• You must provide accurate information when creating an account.
• You are responsible for everything that happens under your account.
• One account per person; accounts are personal and non-transferable.

4. Acceptable use

You agree not to:

• harass, threaten, intimidate, or abuse other users;
• post content that is illegal, hateful, discriminatory, sexually explicit, violent, or otherwise objectionable;
• impersonate any person or misrepresent your identity or affiliation;
• use the Service to send spam or unsolicited promotion;
• attempt to access other users’ data, probe, or disrupt the Service;
• use the Service for any unlawful purpose.

5. User-generated content and zero-tolerance policy

The Service lets you publish content visible to your crew’s members: feed posts and photos, comments, and chat messages (“User Content”).

Leeka has zero tolerance for objectionable content and abusive users. This includes, without limitation: hate speech, slurs, harassment, threats, sexual content, content that exploits or endangers minors, and any content that is illegal in France or in your jurisdiction.

By using the Service you agree that:

• you will not post objectionable content as described above;
• objectionable content may be removed without notice;
• accounts that post objectionable content or abuse other users may be suspended or permanently removed without notice;
• Leeka may use automated filtering to reject content containing abusive language before it is published.

6. Reporting and blocking

The Service provides in-app tools to:

• Report any post, photo, comment, chat message, or user (via the “…” menu on posts and comments, a long-press on chat messages, whether text or photo, or the report actions on a user’s content);
• Block any user — you will immediately stop seeing their posts, comments, and chat messages, and stop receiving notifications about their activity. You can manage blocked users in Settings → Support → Blocked users.

We act on objectionable-content reports within 24 hours, by removing the content and/or ejecting the user who provided it where warranted. To report content or conduct outside the app, contact us at support@leeka.app.

7. Your license to us; our license to you

You retain ownership of your User Content. You grant Leeka a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your User Content within the Service (i.e., to the members of your crew) for as long as it remains published.

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Leeka app on devices you own or control, subject to these Terms and to the rules of the app store from which you downloaded it.

8. Account deletion

You can delete your account at any time in the app (Settings → Delete account), or without the app at leeka.app/delete-account.

Account deletion is final and irreversible. Deleting your account:

• permanently scrubs your profile (name, photo, bio, and other personal details);
• signs you out of all devices and disables future sign-ins with that identity (including Sign in with Apple / Google for that account);
• does not remove the underlying account login record, including your email address, which is retained in order to prevent re-registration with the same identity;
• does not remove content you published to your crew (posts, photos, comments, chat messages, session votes): that content remains, attributed to a “removed member”, because other members’ training records depend on it.

You will not be able to re-register using the same email address or the same Apple/Google identity. See the Privacy Policy for details on data retention.

9. Safety, health, and information

The user acknowledges that running carries inherent risks, in particular cardiovascular and musculoskeletal risks and risks related to road traffic.

Before any participation, the user declares:

• (i) that they have no medical contraindication to running, and undertakes to consult a doctor in the event of doubt or of a prior medical condition;
• (ii) that they hold valid personal civil-liability insurance.

During the session, the user undertakes to comply with the highway code and to respect other users of the public highway, to adapt their effort to their capacities, to have suitable equipment and, in low-visibility conditions, reflective or illuminated equipment.

LEEKA recommends giving up the session, or adapting what it involves, in degraded weather conditions, in particular extreme heat, black ice, storms, or high air pollution.

In the event of illness or an accident, the user or the participants present are to contact the emergency services immediately (15 or 112), then inform LEEKA through the run’s chat.

No participant — including one who has taken the initiative on a warm-up, a pace, or a route, and including where a “coach” or “admin” label is associated with them in the app — is an employee, a trainer, or a sports instructor of LEEKA. LEEKA is not responsible for the conduct of other runners.

10. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind. To the maximum extent permitted by applicable law, Leeka disclaims all warranties and shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including French consumer law).

The limitations set out in this article do not apply in any circumstances to personal injury, nor to LEEKA’s liability for fault personally attributable to it.

11. Termination

We may suspend or terminate your access to the Service at any time for breach of these Terms (including §4–§5), or discontinue the Service entirely. You may stop using the Service at any time; §8 governs account deletion.

12. Changes to these Terms

We may update these Terms from time to time.

Any material change to these Terms is notified individually to the user, by email or by an in-app notification, at least thirty (30) days before it takes effect. A user who does not accept the new version may delete their account free of charge before that date.

13. Governing law

These Terms are governed by French law. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Paris, France, without prejudice to mandatory consumer-protection rules of your country of residence.
